The Motorbuff Website and Mobile Application is a product of Druscilla Private Limited. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Druscilla Private Limited regarding your access to and use of the Motorbuff Service. By downloading, installing, or using the “Service”, you agree to be bound by these Terms. If you do not agree, you must not access or use the “Service”.

1. Electronic Contract

These Terms are an electronic record under the Information Technology Act, 2000, and rules thereunder, as amended. They do not require physical, electronic, or digital signatures and are published in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates the publication of rules, regulations, privacy policy, and terms for access or usage of the Service.

2. Company Information

The Motorbuff Service is owned and operated by Druscilla Private Limited [CIN: U47711UP2023PTC183575], a company incorporated under the Companies Act, 2013, with its registered office at Druscilla Private Limited, 52, Ground Floor, Block F, Pratap Vihar, Ghaziabad, Uttar Pradesh – 201009, India.. These Terms govern your use of the Service and the services offered through it (“Services”).

3. Entire Agreement

These Terms, along with the following documents/policies, form the entire agreement (“Agreement”) between you and Druscilla Private Limited:

• Privacy Policy (available at www.druscilla.com/privacy-policy)
• Additional Terms and Conditions (where applicable, including terms imposed by app stores such as Google Play or Apple App Store)

These documents are incorporated by reference. Your use of the Service is strictly governed by this Agreement.

4. Acknowledgment

By accessing or using the Service, you acknowledge that:

• You have read, understood, and agree to be bound by these Terms.
• Your use of the Service is at your own discretion and risk.
• Druscilla may engage third-party service providers to enhance Services, monitor user activity, and analyze data to improve user experience. You authorize Druscilla and its third-party providers to collect, store, analyze, and use information related to your use of the Service for data analysis, verification, or improving Services, subject to the Privacy Policy.
• Druscilla is not responsible for services availed from third parties or payments made to them. Any issues with third-party services must be addressed directly with those parties.
• Links to third-party websites may be provided, but Druscilla is not responsible for their content or security.

5. Eligibility

The Service and Services are available only to individuals who:

• Are at least 18 years of age and legally competent to enter into a contract under the Indian Contract Act, 1872 (as amended from time to time), or any other act or enactments to which the person is subject.

Druscilla is not responsible for transactions between users and does not guarantee the accuracy or applicability of any information.

By using the Service, you agree that:

• Your use is at your own risk and discretion.
• Druscilla may modify, suspend, or discontinue any part of the Service or Services without notice.
• Druscilla is not liable for any modifications, suspensions, or discontinuations.
• You are responsible for verifying information before acting on it.

You acknowledge that your use of the information on the Service is at your own risk. You are responsible for verifying the accuracy of any information before relying on it and are advised to conduct independent inquiries as necessary. Additional terms from app stores (e.g., Google Play, Apple App Store) may apply and are incorporated by reference.

7. Services

The Motorbuff Service provides a platform for users to explore automotive information and services, including but not limited to:

• Information on new and upcoming vehicles (e.g., prices, specifications, images).
• Research tools for vehicle prices, specifications and warranty.
• Posting user-generated content, such as images and text, in the discussion section to engage in conversations and address automobile-related queries.
• Features like vehicle comparisons or user reviews.
• Sending SMS/email notifications to contacts (with user consent) about Services.

Druscilla may add, modify, or discontinue Services at its discretion without notice or liability.

8. Features and Content

• Content: Includes all information, data, text, images, videos, or other materials available on the Service, including user-generated content and third-party content.
• Features: Interactive or value-added services, such as vehicle comparisons or visual tools.

Users may upload User Content (e.g., reviews, images or text). You are solely responsible for User Content you post, ensuring it complies with applicable laws and does not infringe third-party rights. By posting User Content, you grant Druscilla a perpetual, non-revocable, worldwide, royalty-free, sub-licensable license to use, reproduce, modify, and distribute it. Druscilla does not endorse User Content that violates these Terms or applicable laws and may remove such content without notice.

9. User Account and Login Options

• Guest Users: Can access limited features without registration.
• Registered Users: Must provide accurate details (e.g., name, email, contact) to create an account. You are responsible for maintaining account confidentiality and all activities under your account.

Druscilla may suspend or delete accounts with false or inaccurate information. Data collection and use are governed by the Privacy Policy.

10. User Responsibilities

You agree to:

• Use the Service only through authorized interfaces provided by Druscilla.
• Not post or share content that:
  • Infringes intellectual property or privacy rights.
  • Is harmful, defamatory, obscene, or unlawful.
  • Harms minors or violates applicable laws.
  • Contains viruses or disrupts Service functionality.
  • Misleads or impersonates others.
• Not engage in unauthorized access, data mining, or activities that disrupt the Service.
• Not use the Service for unlawful purposes or to solicit illegal activities.

Druscilla may remove or restrict content violating these Terms and report illegal activities to authorities.

11. Consumer Protection

Druscilla complies with the Consumer Protection Act, 2019. Information on vehicles or services (e.g., prices, specifications, dealer details) is provided as received from third parties. For grievances related to Services, contact our Grievance Officer at grievance@druscilla.com. Complaints will be addressed within 30 days as per applicable law.

12. Data Protection

Druscilla complies with the Digital Personal Data Protection Act, 2023. Your personal data is processed with explicit consent, as outlined in our Privacy Policy. You have the right to access, correct, or request deletion of your data. In case of a data breach, we will notify you as required by law. Data is processed within India, and any cross-border transfers will comply with applicable regulations.

13. Content Moderation and Compliance

Druscilla complies with the Information Technology (Intermediaries Guidelines) Rules, 2021. Unlawful or harmful content may be reported to our Grievance Officer at grievance@druscilla.com. We will review and resolve complaints within 72 hours for urgent cases (e.g., explicit content) or 15 days for others. Druscilla may proactively monitor and remove content violating these Terms or applicable laws.

14. Payments and Refunds

Access to the Service is currently free, but Druscilla reserves the right to introduce fees for premium Services. If fees are introduced, payments will be processed via secure third-party gateways (e.g., cards, UPI). Refunds for any paid Services will be processed within 7-14 days, subject to eligibility. For payment disputes, contact support@druscilla.com. Druscilla is not liable for third-party payment failures.

15. Termination and Suspension

Druscilla may suspend or terminate your access to the Service for violating these Terms, non-payment, or other lawful reasons, with or without notice. Upon termination, you may request data retrieval within 30 days, subject to legal obligations. To appeal a suspension, contact contact@druscilla.com within 7 days.

Druscilla may disclose information related to violations of these Terms or applicable laws to government authorities, with or without request, for purposes such as user identity verification, or the prevention, detection, investigation, prosecution, or punishment of offenses. You are advised to refrain from any activities or use of the Service that violate applicable laws, regulations, or these Terms.

16. Force Majeure

Druscilla is not liable for delays or failures in performance due to events beyond its reasonable control, including natural disasters, government actions, cyberattacks, or pandemics. Affected obligations will be suspended for the duration of the event.

17. Geographic Scope

The Service and Services are primarily intended for users in India. Users accessing the Service from outside India do so at their own risk and must comply with local laws. Druscilla does not guarantee compliance with foreign regulations.

19. External Websites and Third-Party Content

The Service may include links to third-party websites or content (e.g., dealer details, vehicle specifications). Druscilla does not control or endorse third-party content and is not liable for any losses arising from its use. You access third-party websites at your own risk.

Third-party vendors, such as Google, may use cookies or other tracking technologies to serve personalized advertisements on the Service based on your interactions with the Service or other websites. You may manage or opt out of personalized ads by visiting Google’s Ads Settings at https://adssettings.google.com or opt out of targeted advertising from Network Advertising Initiative (NAI) member ad networks at https://www.networkadvertising.org/choices.

By posting User Content (e.g., images, reviews) on the Service, you acknowledge that such content may be publicly accessible and may appear in search engine results (e.g., Google, Bing), search engine caches, feeds, or third-party websites through co-branding or syndication agreements. Druscilla is not responsible for the indexing, caching, or removal of such content by third parties, and it is the sole responsibility of those search engines, websites, or feed providers to update or remove content from their platforms. Druscilla is not liable for any information published in search results or by third-party websites that display content from the Service.

20. Intellectual Property Rights

All content on the Service (e.g., text, graphics, logos, designs, source code) created by Druscilla is owned by Druscilla Private Limited or its licensors and is protected by copyright, trademark, and other applicable laws. Users may not reproduce, distribute, modify, or use such content for commercial purposes without prior written consent from Druscilla or the relevant rights holder.

The Service may display third-party trademarks, logos, images, or other content (e.g., vehicle manufacturer logos, vehicle images, or specifications) provided by automotive manufacturers, dealers, or other third parties. Such content is used solely for informational purposes to assist users in vehicle research and comparison. Druscilla Private Limited does not claim any ownership, rights, or licenses to these third-party trademarks, logos, images, or content, which remain the exclusive property of their respective owners. Any use of such content by Druscilla is intended to be fair and non-commercial, in compliance with applicable intellectual property laws.

Unauthorized use of any content, including third-party trademarks or Druscilla-owned materials, may result in legal action by Druscilla or the respective rights holders. All rights not expressly granted herein are reserved by Druscilla Private Limited.

21. Warranty Disclaimer and Liability Limitations

The Service and Services are provided “AS IS” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. Druscilla does not guarantee uninterrupted, secure, or error-free access, or the accuracy of results. Druscilla is not liable for:

• Delays, interruptions, or data corruption.
• Losses from unauthorized account access.
• Third-party content or services.
• Events beyond its control.

Druscilla’s aggregate liability is limited to INR 100 or the fees paid by you, whichever is greater.

22. Indemnification

You agree to indemnify and hold Druscilla, its affiliates, and their respective officers, employees, and agents harmless from any claims, losses, or damages arising from:

• Your breach of this Agreement.
• Your use of the Service.
• User Content or third-party claims.
• Violation of third-party rights.

23. Platform for Communication

The Service acts as an intermediary under the Information Technology Act, 2000, facilitating user interactions. Druscilla is not a party to transactions between users and is not liable for non-performance or breach of user agreements. You are responsible for transaction terms. Druscilla may communicate with you electronically, and you consent to receive such communications.

24. Abuse and Feedback

Users must not post abusive, hateful, or unlawful content. Report violations to contact@druscilla.com. Feedback or User Content is non-confidential, and Druscilla may use it without obligation or compensation.

25. Arbitration

Any disputes arising from this Agreement or your use of the Service shall be resolved through arbitration by a sole arbitrator appointed by Druscilla, per the Arbitration & Conciliation Act, 1996. The arbitration shall be conducted in English in Ghaziabad, Uttar Pradesh, India. A written Notice of Dispute must be sent to Druscilla at the address below before initiating arbitration.

26. Governing Law and Jurisdiction

This Agreement is governed by Indian law. Subject to the arbitration clause, disputes shall be subject to the exclusive jurisdiction of courts in Ghaziabad, Uttar Pradesh, India.

27. Account Deletion

To delete your account:

1. Open the Motorbuff mobile application and log in.
2. Go to My Account > Profile Settings.
3. Select Delete Account, agree to the terms, and confirm.

Upon deletion, personal information is removed from our database, except for data required for legal or compliance purposes (e.g., transaction records).

• Severability: If any provision is invalid, the remaining provisions remain enforceable.
